1. Welcome and Company Overview

Welcome to Proactive Risk. We are a veteran and first responder owned and operated cybersecurity and risk management firm. We provide enterprise-grade solutions, including Strategic Advisory (NIST, CMMC, HIPAA), Threat Detection, and Security Operations. Our mission is to provide scalable, adaptive protection so our clients can move forward with confidence.

This Employee Handbook is designed to provide an overview of our workplace policies, expectations, and your rights as an employee under federal and New Jersey law.

2. Nature of Employment (At-Will Employment)

Employment with Proactive Risk is "at-will." This means that either the employee or Proactive Risk may terminate the employment relationship at any time, with or without cause, and with or without notice. Nothing in this handbook creates a contract, guarantee, or promise of continued employment. Only a written agreement signed by the CEO of Proactive Risk may modify the at-will relationship.

3. Equal Employment Opportunity and the CROWN Act

Proactive Risk is an equal opportunity employer. We do not discriminate on the basis of race, color, religion, sex, sexual orientation, gender identity or expression, national origin, ancestry, age, disability, pregnancy, military status, or any other characteristic protected by law.

In accordance with the New Jersey CROWN Act, our protections against identity-based discrimination include protections against discrimination based on traits historically associated with race, including, but not limited to, hair texture and protective hairstyles such as braids, locks, and twists.

4. Anti-Harassment, Anti-Discrimination, and Anti-Retaliation

Harassment, discrimination, or retaliation of any kind is strictly prohibited. This includes verbal, physical, or electronic conduct that creates an intimidating or hostile work environment. Employees should report concerns promptly to management. All reports will be investigated. Proactive Risk prohibits retaliation against any employee who makes a good-faith report or participates in an investigation.

5. Work Hours, Attendance, and Timekeeping

5.1 Standard Work Schedule

The standard workweek for full-time employees is forty (40) hours per week. The standard workday is from 9:00 AM to 5:30 PM, Monday through Friday.

5.2 Meal and Rest Periods

Employees are provided with a thirty (30) minute unpaid lunch break each day. The lunch break should be taken free of all job duties. If an employee is required to work during their lunch break, that time must be recorded as hours worked.

5.3 Timekeeping

All non-exempt employees must accurately record their hours worked daily. Proactive Risk utilizes the Intuit Workforce application for timekeeping. Employees must "punch in" at the start of their shift and "punch out" at the end of their shift, as well as for their unpaid lunch period. Working "off the clock" is strictly prohibited.

6. Compensation and Payroll

6.1 Payment Frequency

Employees are paid on a bi-weekly basis.

6.2 Overtime

Non-exempt employees will receive overtime pay at a rate of one and one-half (1.5) times their regular rate of pay for all hours worked in excess of forty (40) hours in a single workweek. All overtime must be authorized in advance by management.

6.3 Commission and Profit Sharing

If an employee is eligible for commissions (e.g., 20% of profit on sales of labor or products), such commissions are generally calculated and paid on a quarterly basis after the company has successfully collected the full payment from the client, subject to the terms of the individual’s Sales Commission Plan.

7. New Jersey Paid Sick Leave

In accordance with the New Jersey Paid Sick Leave Law, employees accrue one (1) hour of paid sick leave for every thirty (30) hours worked, up to a maximum of forty (40) hours per benefit year. Sick leave may be used for personal illness, care of a family member, or other legally permitted reasons.

8. State-Mandated Benefits (FLI and TDI)

New Jersey employees are covered by the state's Temporary Disability Insurance (TDI) and Family Leave Insurance (FLI) programs. These programs provide partial wage replacement for non-work-related illnesses, injuries, pregnancy, or for bonding with a new child or caring for a family member with a serious health condition. These benefits are funded through employee payroll deductions and administered by the State of New Jersey.

9. Social Media Privacy

In compliance with New Jersey law, Proactive Risk will not require or request an employee or applicant to provide a username or password for a personal social media account, or to provide access to a personal account in the presence of the employer.

10. Information Security and Acceptable Use

As a cybersecurity firm, Proactive Risk maintains high standards for data protection.

  • Company Systems: Computers and networks are for business use.
  • Confidentiality: Employees must safeguard client data and proprietary company information at all times.
  • Security Protocols: Employees must adhere to all multi-factor authentication (MFA) and encryption requirements. Unauthorized software installation is prohibited.

11. Electronic Monitoring Notice

Pursuant to N.J.S.A. 34:6B-20, employees are hereby notified that Proactive Risk may monitor any and all electronic communications or activities performed on company-provided hardware, software, and networks. This includes, but is not limited to, email usage, internet browsing history, and data stored on company cloud platforms. Employees should have no expectation of privacy when using company systems.

12. Captive Audience Ban

In accordance with New Jersey law, Proactive Risk will not discharge, discipline, or penalize an employee because the employee declines to attend or participate in an employer-sponsored meeting or communication, the primary purpose of which is to communicate the employer’s opinion on religious or political matters (including opinions regarding labor organizations).

13. Smoke-Free Workplace

Proactive Risk maintains a smoke-free and vape-free environment. Smoking and the use of e-cigarettes or "vaping" is strictly prohibited inside all company facilities and within twenty-five (25) feet of any entrance or air intake, in compliance with the New Jersey Smokefree Air Act.

14. Paid Holidays

Proactive Risk provides ten (10) paid federal holidays each calendar year:

  2. Presidents’ Day
  3. Memorial Day
  4. Independence Day
  5. Labor Day
  6. Columbus Day
  7. Veterans Day
  8. Thanksgiving Day
  9. Day after Thanksgiving
  10. Christmas Day

15. Workplace Conduct and Discipline

Employees are expected to maintain professional conduct at all times. Proactive Risk reserves the right to use progressive discipline; however, the company may bypass any step in the disciplinary process and terminate employment immediately for serious infractions, including but not limited to theft, violence, or gross breaches of information security.

16. Separation of Employment

Upon separation, employees must return all company-owned equipment (laptops, mobile devices, security badges). Final wages will be paid on the next regular payday in accordance with New Jersey law.
